HANDYMAN DAILY ANNUAL SERVICE AGREEMENT
TERMS AND CONDITIONS LENGTH OF CONTRACT

 

This Annual Service Agreement (“Agreement”) is by and between Arizona Handyman and Remodeling Services LLC, dba Handyman Daily (referred to herein as “HandymanDaily.com” or “Handyman”) and ________________________________, (the “Purchaser”). This Agreement shall be effective for one (1) full calendar year from the date that payment in full is received.

COST

The annual cost of this service Agreement is $419, tax included, for selected services as defined below to be provided at the property located at __________________________________________________, (“Subject Property”), plus a $39 trip charge.

SERVICES

Under this Agreement, the Purchaser is entitled to one (1) service call. The service call is limited to the Subject Property, eight (8) hours in length, and one handyman. Time not used by Purchaser during the service call is forfeited and may not be redeemed for future service. The services provided under this Agreement are limited to the Service Description List attached to hereto and incorporated herein by reference.

If the services required exceed the eight hour limit, Purchaser may elect to purchase an additional Service Agreement at the Discounted Handyman Package Rates or purchase additional time at the Standard Handyman Rates. (See Below For Chart of Rates).

Services not listed on the Service Description List are generally excluded; however, such requests may be accommodated at Handyman’s sole discretion and Handyman’s Standard Rates shall apply.

Handyman will do its best to remove construction debris. Our service technician will take everything that fits in an 8 gallon garbage bag and will neatly pile any larger pieces on Customer’s property per Customer’s direction. Any removal of debris from the premises will be the sole responsibility of the Customer. But, Handyman will be happy to refer Customer to one of Handyman’s hauling subcontractors.

Customer must be home at both the start and completion of the appointment to discuss the project scope set forth in the Customer’s written Service Order with Handyman’s service technician, allow access to work area, and to approve work upon completion. The Customer’s Service Order describing the service work and price is by this reference incorporated herein.

WARRANTIES

Our warranty extends to labor only. From the date of our project completion, Handyman’s new construction workmanship is under warranty for a 12 month period and repairs/modifications to existing workmanship are under warranty for a 30 day period. Our warranty excludes normal workmanship defects defined as natural imperfections visible only by close inspection at a distance of 36” or less and natural curing cracks of caulk, grout, and concrete. Warranties are void of any liability for materials or products supplied by the Purchaser or Purchaser’s representative. Manufacturer warranties apply to all supplied materials as applicable. There are no other guarantees expressed or implied, and Handyman shall not be liable for actual, special, economic, expectation, and/or consequential damages of any nature and/or kind.

PARTS AND MATERIALS

A) Supplies and Materials can be provided by the Purchaser at their own expense; however, Handyman does not warranty any Purchaser-supplied materials. If the Purchaser elects to provide material(s), the Purchaser will be responsible for providing appropriate/accurate materials specific to the job, the Purchaser can reschedule the appointment or agree to select other services from the Service Description List or purchase more time to complete the services.

B) Parts supplied by Handyman will contain a 25% markup and sales tax and billed in addition to the service agreement. There will be an additional delivery fee if the Handyman cannot bring them to the job site due to the size, weight and/or quantity. Purchaser will be informed of the delivery fee prior to scheduling an appointment. Handyman does not assume responsibility or liability for any damage or loss in any way related to Handyman’s alleged failure to obtain parts in a timely manner. For any manufacturer warranty, the Purchaser is to contact the manufacturer directly.

C) Handyman does not include the purchase or matching of paint/stain color(s). Therefore, the Purchaser must provide paint/stain as required for all applicable projects. Should the Purchaser authorize Handyman to provide the paint/stain, discrepancy in color/shade of the paint/stain is not guaranteed by Handyman and will be solely Purchaser’s responsibility.

• Renting Equipment – Pressure washers, generators, and other provided construction equipment carry rental fees. Purchaser will be informed of any applicable rental fee(s) prior to scheduling a service appointment.

APPOINTMENTS AND HOURS

The scheduled services will be performed during regular business hours, Monday through Friday from 8:00 AM to 5:00 PM excluding national holidays and Sundays. Services must be scheduled Three (3) business days in advance. Service intervals under this Agreement are from 8:00 A.M. to 12:00 Noon and 1:00 P.M to 5:00 P.M. Cancellation of a scheduled Appointment: A 24 hour notice is required to cancel a scheduled appointment. Cancellations must be in writing and emailed to info@handymandaily.com or mailed to 5714 W. Palmaire Ave, Glendale Arizona 85301 and received 24 hours prior to the scheduled appointment. Cancellations with less than 24 hours notice result in Purchaser being liable to pay a fee of $104 (Minimum of one hour at our standard rate of $65.00 per hour plus $39 trip charge. Cancellation fee must be paid in advance prior to scheduling another appointment.

TRANSFER TO NEW OWNER

The Purchaser of this Agreement’s rights and obligations under this Agreement shall be transferred during the term of the Agreement to any individual that subsequently purchases or leases his/her property at the address listed on this page. However the new owner must agree to the terms and conditions of this Agreement prior to the transfer. Unless agreed to by Handyman, this Agreement cannot be transferred to a different address other than the address written above.

EXCLUSIONS AND LIMITATIONS

Handyman will not be liable for nor pay for any services performed by anyone other than Handyman, unless authorized in writing, by Handyman. This Agreement shall not apply to any appliance or electronic product covered by an express warranty. Handyman reserves the right to refuse to service/repair any appliance or other component which in its sole discretion is too unsafe, old or worn to warrant further repair and/or service. This Agreement is intended to cover handyman service necessitated as a result of ordinary wear and tear and does not apply to repairs or services necessitated by such intervening causes as wars, floods, water, water damage, lightning, wind and windstorms, earthquakes, fires, smoke, acts of God, thefts, riots, vandalism, or misuse or abuse of a component.

LIMIT OF LIABILITY AND DAMAGES

Handyman entire liability for any claim related to services provided under this Agreement shall in no event exceed the purchase price of the service Agreement. In addition, Handyman will not be responsible for any and all damages arising out of or in any way related to services provided under this Agreement.

INDEMNIFICATION OBLIGATIONS

The Purchaser agrees to defend, indemnify and hold harmless Handyman for any claim, injury or harm suffered by an employee or contractor of Handyman providing services under this Agreement if such claim, injury or harm is due in whole or in part to the negligent acts or omissions of Purchaser or any of the residents of the Subject Property.

ESTIMATED TIME CONTINGENCY

The estimated service time on this Agreement, under Service Description List, is based on industry standards under normal circumstances and is not guaranteed. Some repairs may take longer due to unforeseen conditions.

HEADINGS

Headings contained in this Agreement are for convenience of reference only and are not intended to alter or vary the construction or meaning of this Agreement.

GOVERNING LAW This Agreement shall be interpreted and enforced in accordance with the substantive law of the State of Arizona.

ATTORNEYS’ FEES In the event any dispute arises between the Parties to enforce the terms of this Agreement, the successful or prevailing party to such dispute shall be entitled to an award of  its reasonable attorneys’ fees,  and taxable  costs incurred in enforcing this Agreement.

COUNTERPARTS This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which shall constitute one and the same settlement agreement.  This Agreement may also be executed via facsimile or other electronic signatures, which facsimiles or other electronic signatures shall constitute the original Agreement.

SEVERABILITY If any provision of this Agreement is held to be illegal, invalid or unenforceable under present or future laws effective during the term of this Agreement, such provision shall be fully severable.  In lieu thereof, the Parties agree that there shall be added a provision as similar in terms and effect to such illegal, invalid or unenforceable provision as may be possible and be legal, valid and enforceable.

CANCELLATION

This Agreement may be cancelled within 30-days from the day it was purchased, so long as Purchaser has not used the services purchases. Requests for cancellation shall be made in writing and sent to the Handyman at 5714 W Palmaire Ave. Glendale, Arizona 85301. Upon receipt of a timely notice of cancellation, the Purchaser of this Agreement shall receive a full refund, less 10% to cover administrative and set up cost incurred by Handyman.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Handyman and Purchaser. Each exhibit and schedule hereto shall be considered incorporated into this Agreement. This Agreement supersedes any and all prior discussions, writings, negotiations, proposals, undertakings and agreements, whether written or oral, between or among the Parties. Any amendments or alternative or supplementary provisions to this Agreement must be made in a signed writing and duly executed by an authorized representative or agent of each Party, and reference this Agreement. The terms, policies and conditions contained in the HandymanDaily.com website are by this reference incorporated herein. Should there be any conflict between the terms, policies and conditions in this Agreement and the website, the terms and conditions in this Agreement shall control and prevail.

The Purchaserr has the right to file a written complaint with the Arizona Registrar of Contractors, 602-542-1525, www.azroc.gov, for an alleged violation by the Contractor of A.R.S. §32-1154(A). Complaints must be made within the applicable time period set forth in A.R.S. § 32-1155(A).

Standard Handyman Daily Rates Tax Included.

Standard Weekday Rate: 8AM to 5PM: $65.00/Hour with a one hour minimum. Work preformed after the first hour is billed in 15 minutes increments.
After Hour Weekday Rate: $75.00/Hour.
Weekend and National Holidays Rate: $90.00/Hour with a minimum of 2 hours.
Plus $39 Trip Charge Trip Charge – Each visit to job site will incur a Trip Charge
